Teva Pharmaceuticals is seeking an Executive Counsel - Privacy to support our North American Speciality Medicines buisnesses.  


As a subject matter expert on Privacy and Data Protection, the Executive Counsel for privacy and data protection for Teva’s North America Specialty Medicines (“NASM”) businesses will provide legal advice in support of NASM’s business operations, including Teva’s HIPAA covered entity, Patient Services and Solutions, Inc. and the Shared Solutions Pharmacy. The Executive Counsel will work collaboratively with Teva’s Chief Privacy Officer and the Global Privacy team and will provide legal support to the Global Privacy organization. The Executive Counsel will be a member of the NASM legal department reporting to the NASM Associate General Counsel. 




  • Provide in-depth legal advice on a broad range of US privacy and data protection laws, including without limitation, HIPAA, HITECH, the FTC Act, TCPA, TSR, COPPA, PCI, CAN-SPAM Act and state privacy and security breach laws.
  • Provide privacy-related legal advice regarding Teva’s US Patient Services and Solutions hub and specialty pharmacy activities and US sales and marketing activities, including web/mobile privacy notices, terms of use, and the development and implementation of digital applications and cloud-based platforms. 
  • Work collaboratively with EU Privacy Counsel and Global Privacy Team on EU data protection matters that impact the US, including EU-US Privacy Shield and GDPR related matters. 
  • Provide privacy-related legal advice concerning global business transactions and perform privacy-related legal due diligence and reviews. 
  • Draft, review and negotiate privacy-related language in various types of contracts, including complex global transactions. 
  • Monitor and evaluate evolving laws, regulations and industry best practices with regard to privacy and data protection.
  • Ensure that the company is in compliance with all applicable US privacy-related laws, rules and regulations. 
  • Provide legal advice related to data incidents and work with internal stakeholders to guide their resolution consistent with applicable law and sound business practices.
  • Other projects and duties as required/assigned by Teva’s General Counsel. 


Education Required: J.D. Degree. Must be licensed in Kansas or Pennsylvania or eligible for in-house counsel admission.

Experience Required: 10 years as a practicing attorney with a law firm and/or in-house experience, specializing in privacy and data protection laws.

Experience Pred: Corporate transactional background with experience in negotiating and drafting a variety of complex privacy, data protection, commercial and IT-related agreements. Experience working in the pharmaceutical, biotechnology or medical device industry and familiarity with relevant legal issues, including FDA promotion, anti-kickback, and fraud and abuse matters.

Specialized or Technical Knowledge Licenses, Certifications needed: CIPP or similar professional certification

Functional Knowledge: Substantive knowledge of US privacy laws, including without limitation, HIPAA, HITECH, the FTC Act, TCPA, TSR, COPPA, PCI, CAN-SPAM Act and state privacy and security breach laws. Working knowledge of EU-US Privacy Shield and GDPR.


Job-specific Competencies

1. Demonstrated excellence in (i) understanding complex scenarios in order to identify and evaluate for privacy, security and related legal issues and risks, (ii) propose solutions that take into consideration the relevant business objectives, and (iii) communicate those issues, risks and solutions clearly and concisely to lawyers and non-lawyers alike.
2. Contract drafting and negotiation. Experience in reviewing, drafting and negotiating privacy-related language in various types of contracts, including commercial agreements, IT agreements, complex global agreements, and business associate agreements.
3. Strong research and writing skills.
4. Ability to work independently; ability to handle, prioritize and follow through on diverse issues in a timely manner; ability to guide business partners through complex, evolving business needs.
5. Sound judgment, commitment to ethical conduct and high level of professionalism.
6. Team player with a commitment to developing strong collaborative relationships with clients and cross-functional teams
